Hold Harmless Agreement:

Participant(s) disclaim and waive all claims against all parties indicated above (even if those parties are negligent) and enter into this agreement knowing that motorcycle riding can be a hazardous sport and take full responsibility for any and all injuries or damages.

In consideration of my participation in The West Coast Thunder Parade/Ride (the “Event”) and by execution of this entry form, I/we hereby release Dabney Properties L.L.C., Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, Harley-Davidson Motor Company, CBS Radio Stations Inc., Station KFRG, Soboba Casino, City of Riverside, City of Moreno Valley, City of San Jacinto, County of Riverside, State of California, California Highway Patrol, Riverside County Sheriff’s Department, Shareholders, Officers, Directors, Agents, Employees, Parent Companies, Related or Affiliated Companies, Subsidiaries, Sponsors, Trustees, Receivers, Successors, Assigns, Volunteers and the City in which the Event is held, their employees, members, officers, directors and anyone else connected with this Event of and from any and all known and unknown damages, injuries, losses, expenses, judgments, attorney fees, and/or claims from any causes whatsoever that may be suffered by anyone participating in this Event, or by any spectators, participants, sponsors, exhibitors, employees, volunteers or vendors.

By submitting the registration form, the participant(s) designated herein agrees to give said company, Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, permission to charge a credit card for the sum of the “Total”. By submitting this registration, I/we also understands and agree to a NO REFUND policy no matter what the circumstances and Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, Corona Harley-Davidson, CBS Radio Stations Inc., Station KFRG, Soboba Casino are not responsible for any loss due to theft, injuries, losses, judgments, vandalism or negligence by any spectators, participants, sponsors, exhibitors, employees, volunteers or vendors. The participant(s) understand this does not any way guarantee the location of the Event space or the success or failure of this Event.

Furthermore, I/we agree to waive the protection afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release may not extend to claims, material or otherwise, which the person giving the release does not know of or suspect to exist at the time of executing the release.

I/we hereby grant to Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, Corona Harley-Davidson, CBS Radio Stations Inc., Station KFRG, Soboba Casino and their agents and assigns, without additional financial or other compensation, the right to use my/our name, likeness, portrait, recorded voice and biographical material, in order, without limitation, to advertise, promote or publicize the parties, the Event and any advertisers and co-sponsors associated with the Event and their products and services.

FINANCIAL RESPONSIBILITY RELEASE

Participant Agreement: READ THE FOLLOWING STATEMENTS CAREFULLY. This document discloses the guidelines and responsibilities that accompany participation in the West Coast Thunder Parade/Ride 2011 and the reservation of the rights to enforce said guidelines.

Disclaimer: Dabney Properties L.L.C., Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, Harley-Davidson Motor Company, CBS Radio Station Inc., Station KFRG, Soboba Casino, City of Riverside, City of Moreno Valley, City of San Jacinto, County of Riverside, State of California, California Highway Patrol, Riverside County Sheriff’s Department, and all parents, subsidiaries, members, shareholders, officers, directors, agents, sponsors, trustees, receivers, successors, beneficiaries, and assigns of CBS Radio Stations Inc., Station KFRG, Skip Fordyce Harley-Davidson, in addition to all Event vendors, participants, and sanctioning bodies shall assume no liability or responsibility for injury, theft, damage, or loss that may occur or have occurred while participating in the West Coast Thunder Parade/Ride and participant(s) agrees to hold them harmless there from.

Compliance: Registered drivers is/are adults (eighteen years or older). Participant(s) must possess a valid driver’s license, motorcycle liability coverage with minimum limits of $15,000/30,000 bodily injury, $10,000 property damage or statutory limit in state of motorcycle registration.  Participants may be required to provide proof of a valid license and insurance coverage prior to participation in the Event. The participant(s) acknowledge and understand no insurance is available or coverage to the participant(s) unless otherwise provided by private insurance obtained by the participant(s). Participant agrees to comply with any and all rules of the parade/ride as set forth herein or that may be communicated to them or posted at the Event. Participant agrees to drive within the speed range instructed and shall not pass or overtake any lead rider at any time.

Participant(s) understands and agrees that if his/her vehicle is in an accident and/or causes damage to any real or personal property, whether he/she is driving or another individual is driving with or without participant’s permission or knowledge, participant’s vehicle may be impounded and held until participant reimburses Dabney Properties L.L.C., Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, Corona Harley-Davidson, CBS Radio Station Inc. Station KFRG, Soboba Casino, and/or the injured party for any and all damages. Impounding of vehicles is at the sole discretion of the Dabney Properties L.L.C., Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, CBS Radio Stations Inc., Station, Soboba Casino.

For your safety and the safety of others, do not consume alcohol or other controlled substances before driving your vehicle. Under no circumstances shall any participant or guest of participant be allowed to ride in the parade/ride or take part in any activities if he/she is suspected of being under the influence of alcohol or other controlled substances.

Failure to comply with any and all rules, guidelines, or instructions shall be grounds for immediate expulsion from the Event at the sole discretion of the Dabney Properties L.L.C., Riverside Motorcycle, Inc. DBA, Skip Fordyce Harley-Davidson-Buell, CBS Radio Stations Inc., Station KFRG, Soboba Casino.

Certification: I certify that I have read and understand the above statements. I accept the responsibility to comply with all Event rules and regulations, all of which are subject to change at any time without notice. I acknowledge that I will be held accountable for my actions and the actions of any individual found to be operating my vehicle, with or without my knowledge and/or consent. I understand that non-compliance may result in expulsion from the Event and/or impoundment of my vehicle(s). I acknowledge that the documents provided by me for the Event on May 28, 2012 are valid and issued to me.  I understand that this release is intended to be as broad and inclusive as permitted by law, and I agree that if any portion of this release is deemed invalid, the remainder will continue in full force and effect.  I further understand that this release is to be interpreted under the laws of California, and I submit to the jurisdiction of the courts within California and waive all objections to the jurisdiction or venue of such courts.
